    The French Act No. 2020-1266 of 19 October 2020 strictly regulates the activity of children under 16 on online platforms.     The Legal Framework of Commercial Influence in France.

    Law No. 2023-451 of June 9, 2023 (loi visant à encadrer l'influence commerciale et à lutter contre les dérives des influenceurs sur les réseaux sociaux) constitutes the founding text of influence law in France.

    It imposes enhanced transparency obligations on influencers: clear and unambiguous identification of the commercial nature of publications (mentioning 'Advertising' or 'Commercial collaboration'), prohibition of promoting certain products and services (cosmetic surgery, sports betting to minors, high-risk financial products, nicotine, etc.), and mandatory written contracts with advertisers.

    Penalties for non-compliance can reach €300,000 in fines and 2 years of imprisonment. The DGCCRF (Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes) is the competent authority for enforcing these provisions. Ordinance No. 2024-978 of November 6, 2024 supplemented this framework by harmonizing French law with the European framework.

    Case law has already sanctioned failures by influencers to comply with transparency obligations, notably through transactional fines imposed by the DDPP for promoting NFTs without disclosing their advertising nature.

    More recently, complaints filed by the Collectif AVI against Poupette Kenza and Dylan Thiry (March 2024) illustrate the determination of authorities and consumer associations to pursue abuses in the influencer sector. The DGCCRF has the power to issue compliance injunctions, request the delisting of accounts on social networks, and publish sanction decisions (name and shame strategy).

    The most serious offences (misleading commercial practices) are punishable by 2 years of imprisonment and a €300,000 fine. In 2024, the DGCCRF inspected more than 260 influencers, revealing irregularities in 40% of cases.     Compliance with the Act of 9 June 2023 and DGCCRF controls.

    Act No. 2023-451 of 9 June 2023 to regulate commercial influence has profoundly renewed the legal framework applicable to content creators and their agents. Our firm deploys comprehensive compliance and defends our clients during administrative and judicial controls.

    Mandatory mentions and commercial transparency.

    Any commercial content, including in the esports sector, must be identified by the mentions 'Advertising' or 'Commercial collaboration' clearly, legibly and identifiably throughout the viewing duration. Filtered or retouched images must include the mention 'Retouched images'. AI-generated images must include the mention 'Virtual images'.

    Sanctions go up to €300,000 fine and 2 years' imprisonment (Articles L.121-2 and L.132-2 of the Consumer Code).

    Prohibited or restricted products and services.

    The Act prohibits the promotion of cosmetic surgery, therapeutic abstention, unregulated risky financial products, crypto-assets outside approved PSAN providers, sports betting outside France, cosmetic medical procedures without supervision. It restricts alcohol (Évin Act), gambling (ANJ), medicines (ANSM), medical devices. Promotion targeting minors is subject to specific restrictions.

    Agent's liability and joint liability with the advertiser.

    The influencer agent must sign a written contract with their influencer (mandate of representation) and the advertiser. They are bound by a strengthened obligation of means and must justify professional liability insurance.

    The Act establishes joint and several liability between the influencer, their agent and the advertiser in case of breach of transparency obligations or promotion of prohibited products, implying a rigorous contractual chain and reciprocal warranty clauses.

    Adult-content creators and management agencies.

    Adult-content creator management agencies (the so-called OFM model, for OnlyFans Management) fall within a specific legal regime, at the intersection of influencer law, contract law and criminal law.     Since the law of June 9, 2023, influencers must clearly indicate the commercial nature of their publications, comply with sector-specific prohibitions (cosmetic surgery, sports betting for minors), and enter into a written contract with advertisers when the total fees exceed €1,000 excl. VAT per year and per advertiser (threshold set by decree since January 1, 2026).

    The Law of 9 June 2023 applies whenever content targets a French audience, regardless of where the influencer is established. The Ordinance of 6 November 2024 clarified this criterion by retaining the targeting of a French audience as the determining factor.

    An influencer based in Dubai or London who creates French-language content for a French audience is therefore subject to the transparency and contractualization obligations provided by law.

    The Law of 9 June 2023 prohibits influencers from directly or indirectly promoting certain high-risk financial products, notably financial contracts relating to assets not admitted to trading on a regulated market. The promotion of crypto-assets is regulated by the MiCA Regulation (EU 2023/1114), which imposes enhanced information obligations.

    Any promotion must include a risk warning and clearly state its advertising nature.

    Article 8 of the Law of 9 June 2023 establishes joint liability between the agent and the influencer for compliance with transparency obligations. If an influencer managed by an agency fails to disclose the advertising nature of content, the agency can be prosecuted and sanctioned under the same conditions.

    This joint liability requires agencies to maintain constant vigilance and implement internal control procedures.

    A partnership contract is a commercial agreement between an independent influencer and a brand, while an employment contract implies a relationship of subordination. Courts may reclassify a partnership as an employment contract if the influencer receives precise instructions regarding content, schedules, and execution methods.
