What is the role of a lawyer for recovering an Instagram account ?
We act in all 27 EU Member States, in the United States and worldwide. Recovering a suspended, hacked, deactivated or banned Instagram account starts with a legal demand letter served on Meta Platforms Ireland Limited, based on Articles 17 and 20 of the DSA (Regulation (EU) 2022/2065), which require a detailed statement of reasons for any suspension and keep the internal complaint mechanism open for six months. For accounts held with Meta Platforms, Inc. in the United States, we act under California law and Meta's own terms of service, through its US complaint channels. Elsewhere, the same demand rests on the platform's terms, the law of your place of residence and the group entity that actually controls the account, with local counsel where a local filing is needed. Where a refusal stands, we file an urgent court application before the competent court to seek restoration.
Where we act
EU, United States, rest of the world.
In all 27 EU Member States.
The DSA and the GDPR apply identically in every Member State. From Germany to Spain, Italy, the Netherlands or Poland, our legal demand letter is served on Meta Platforms Ireland Limited on the same grounds as for any other EU client.
In the United States.
American Instagram accounts are governed by the terms concluded with Meta Platforms, Inc., which designate California law and the courts of the Northern District of California or San Mateo County (and arbitration where the terms provide for it). Our demand relies on those terms, on California consumer rules where they apply and on escalation to the company's counsel, alongside US counsel when local representation is required. The fee can be quoted from $950 USD.
Everywhere else in the world.
United Kingdom, Switzerland, Canada, the Middle East, Africa or Asia: we build the demand on the terms of service you accepted, on the law of your country of residence and on the group entity competent for your region, working with local counsel where a court filing is needed.

Legal framework by region
EU: the DSA requires Meta to justify every decision.
The EU Digital Services Act (Regulation 2022/2065) has required Meta, designated as a Very Large Online Platform, to individually justify each moderation decision affecting a European user since August 2023. Article 17 of the DSA compels Instagram to provide a clear justification of the suspension, stating the rule breached and the available internal appeals. When the statement of reasons received is incomplete or erroneous, our firm builds its legal demand letter on that breach to compel Meta to re-examine the case. The DSA covers users located in the European Union. For clients based elsewhere, we rely instead on the contractual commitments of the terms of service, on the law of the client's country of residence and on the remedies open before Meta Platforms Inc., which changes the legal basis but not the method.
United States: the platform's own terms are the legal basis.
Instagram accounts held in the United States are governed by the terms of service concluded with Meta Platforms, Inc., which designate California law and the courts of the Northern District of California or San Mateo County. Our legal demand relies on the commitments Meta has made in those terms, on the consumer protection and privacy rules of the State where you live where they apply (for example the California Consumer Privacy Act and its right of access to your personal data), and on direct escalation to the company's legal team. Where the matter goes further, individual arbitration or the court designated in the terms are two possible routes, assessed case by case, with US counsel where local representation is required. The fee is quoted from $950.
Rest of the world: your country's law and the platform's terms.
Outside the EU and the United States, the case rests on the terms of service you accepted, on the consumer and data protection law of your country of residence and on the Meta group entity competent for your region. In the United Kingdom, we rely on the UK GDPR and the platform duties under the Online Safety Act; in Switzerland, on the Federal Act on Data Protection; in Canada, on federal and provincial privacy laws. The same method applies in the Middle East, Africa and Asia, with local counsel where a filing on site is needed.
The most frequent reasons for Instagram suspensions.
The majority of suspended, disabled or locked Instagram accounts we handle fall into five categories: mass abusive reports from competing accounts, erroneous detection of automated activity on legitimate human actions, identity-impersonation complaints, content flagged as nudity by computer-vision algorithms, and suspicion of circumventing a prior ban. Whether the account is merely locked as a precaution or disabled in a manner presented as permanent, precisely identifying the actual ground allows us to focus the legal arguments enforceable against Meta and to accelerate the recovery procedure.
Identify the exact ground of suspension before taking action.
Before any contentious step, we ask our clients to retrieve the exact wording of the rule invoked in the Instagram Account Status panel (Profile, menu, Account Status, Learn more about this rule) or in the email sent by Meta Support. That qualification drives the legal argument and the identification of any breach by Meta of its statement-of-reasons obligation under Article 17 of the EU Digital Services Act (DSA). A vague, generic or contradictory ground already constitutes a usable lever in the legal demand letter.
The exhibits we ask for to build your case.
To engage the firm efficiently, we expect dated screenshots of the suspension notification, the account handle and username, any prior violations displayed in the Account Status, the list of Instagram and Facebook accounts linked through the Meta Accounts Center, the content published at the time of the block, and any earlier exchanges with Meta. The quality of these exhibits directly drives the speed of review and the evidentiary strength of the legal demand letter. Without them the procedure remains possible but timelines lengthen.
Real-world timelines observed by our firm.
Article 20 of the DSA requires diligent and timely handling of internal complaints without setting a fixed time limit. Meta in practice communicates an indicative deadline of around 7 days to respond to an internal complaint, which may be extended in complex cases. In practice, our legal demand letters addressed to Meta's counsel reach a decision within an average of about one month. Temporary suspensions (24h, 7 days, 30 days) are legally distinct from permanent deactivations, the latter requiring denser argumentation and additional legal grounds. These timelines apply in the same way to files outside the European Union, the legal demand letter then being addressed to the group entity competent for your region.
What to do when your internal appeal has already been rejected.
A rejected appeal through the native Instagram external appeals form or the Account Status workflow does not close the door to a new remedy. Article 20 of the DSA compels Meta to re-examine any complaint presenting new factual elements. Our firm builds an argumentation that differs from your first appeal, exploits statement-of-reasons defects and addresses the legal demand letter to Meta's internal counsel rather than to self-service tools. Clients located outside the European Union follow the same route, the demand being addressed to the entity of the group that handles their region.
Bringing the dispute to court when Meta refuses to cooperate.
When the legal demand letter and out-of-court avenues fail, the firm initiates judicial proceedings. For personal-use accounts, we file interim relief proceedings before the competent court as urgent interim relief to end a clearly unlawful situation, together with pre-action evidentiary measures where needed, with substantive grounds drawn from the right to privacy, civil liability, Articles 15 and 16 of the GDPR and Article 17 of the DSA. For professional accounts operated as economic assets by creators, brands or companies, we bring the action before the competent commercial court to obtain reactivation and compensation for business losses, lost revenue, harm to commercial image and termination of contracts with partners and advertisers. Where hacking or impersonation is involved, the firm assists in filing a criminal complaint for identity theft and unauthorized access to a computer system. For clients established outside the European Union, we assess jurisdiction in light of the platform's terms of service, the client's domicile and the applicable international conventions, working alongside local counsel when the case calls for it.
FAQ
Frequently asked questions.
Yes. Our account recovery lawyers act for clients in the United States, as well as across the EU and worldwide. We build the file, send a legal demand letter to the Instagram legal team and follow up until the account is restored.
The flat fee is $950 for the United States and the rest of the world, or €850 in the European Union, all inclusive, with a written fee agreement and a reply within 24 hours.
Instagram provides a recovery flow from the login screen ("Need more help?", then the option for losing access to your recovery methods), which lets you report the situation and may trigger an identity check, sometimes through a video selfie.
When this automated channel fails, which is common, we rebuild proof of your digital identity (ID documents, phone bills, Meta ad payment history, past correspondence with Meta) and demand an adversarial identity verification under the rectification right in Article 16 of the GDPR, backed by a legal demand letter sent to the competent Meta entity.
Immediately preserve all evidence of your previous control of the account: old Instagram sign-in emails, profile screenshots, identifiers, Meta ad or subscription invoices.
Report the hack through Meta's dedicated form, then file a criminal complaint for identity theft and fraudulent access to a data processing system: the complaint is strong evidence in the legal demand letter we then send to Meta to obtain restoration of the account and reversal of the hacker's changes.
Based on the hundreds of cases handled by the firm, the average timeframe is around one month from the date our legal demand letter reaches Meta. Straightforward files, such as an erroneous suspension or a well-documented hacking, are often resolved faster; accounts presented as permanently disabled or files involving repeated violations require a denser legal argument and may take longer.
Meta, Instagram's parent company, may decide to suspend your account if it detects a violation of its terms of service. However, since its judgment is mostly algorithm-based, errors are frequent. That's where we step in: to make Meta see reason and reverse its decision.
Yes. We act for clients from every country of origin. Wherever you live in the European Union, from Germany to Spain or Poland, we rely on the DSA and the GDPR. In the United States, we act under the platform's US terms.
Anywhere else, we build the case on the terms of service you accepted, on the consumer and data protection rules of your country of residence, and on the remedies open before the group entity that actually controls the account (Meta Platforms Inc., TikTok USDS Joint Venture LLC, Snap Inc. or Google LLC depending on the service). We work in English and several other languages.
Yes. The DSA and the GDPR are EU regulations: they apply in the same way in all 27 Member States.
Whether you live in Germany, Spain, Italy, the Netherlands, Poland, Ireland or any other Member State, our legal demand letter is served on Meta Platforms Ireland Limited, the entity that handles Instagram accounts for Europe, on the same legal grounds and at the same flat fee. The whole case is handled remotely, in English and several other languages.
Yes. A United States Instagram account is governed by the terms of service concluded with Meta Platforms, Inc., which designate California law and the courts of the Northern District of California or San Mateo County (and arbitration where the terms provide for it). The DSA mechanism does not apply to that contract, so our legal demand letter is built on the commitments Meta has taken in its own terms, on California consumer rules where they apply, and on escalation to the company's internal counsel.
We then assess whether arbitration or a court filing serves the file better, working alongside US counsel where local representation is required. The fee can be quoted in dollars, from $950 USD.
We find that in the overwhelming majority of cases handled by our firm, when it is indeed an error on Meta's part during suspension or banning, or in cases of hacking, we succeed in recovering our clients' Instagram accounts.
Note that we also intervene if your appeal has been previously rejected by Meta. Our fee is fixed and agreed in writing upfront: professional ethics rules do not allow lawyers to tie their fees to the outcome, so you always know exactly what you pay.
Most users acting alone, through internal appeals or an out-of-court dispute settlement body, obtain no reversal. Appeals are usually brief, raise no legal ground enforceable against the platform and never reach its legal team. A specialized law firm changes this: a legally substantiated legal demand letter, based on the platform's own obligations, addressed directly to its counsel.
Our fees, from €850 (European Union) or $950 (United States and worldwide), include: building your case and analyzing your supporting documents, drafting the contextualized and legally substantiated legal demand letter, sending by tracked registered or certified mail to Meta, exchanges and negotiations directly with Meta, assistance in guiding you through restoring your account.
This flat fee covers one account: if several accounts are involved, a tailored quote is provided. Your fixed fee is confirmed in writing before we start.
No, we are a fully independent law firm. We rely on the European regulations and, for clients outside the European Union, on the rules applicable in their own jurisdiction.
A deactivation presented as permanent by Meta is not legally irreversible. As long as the account data remains stored on Meta's servers, restoration remains technically possible and legally enforceable when the statement of reasons is deficient under Article 17 of the DSA or when the alleged facts are erroneous. Our firm regularly contests bans presented as permanent.
Yes. When amicable and out-of-court avenues fail, we file interim relief proceedings before the competent court to obtain reactivation and, where appropriate, compensation for the prejudice suffered. For Instagram accounts operated professionally, the action is brought before the competent commercial court to obtain compensation for business losses, lost revenue and harm to commercial image.
